Scope, Purpose, and Legal Basis for Processing, and Retention Period for Personal Data

The scope of the personal data we process may vary depending on the services and features of the website. To help you understand what personal data we process, we have listed below information about the types of data we process, categorized by functionality and purpose of processing.

For each processing purpose, we have specified the legal basis for the processing and the retention period for the personal data. We will retain your personal data for as long as it is necessary for the purpose for which it is being processed. Once the purpose has been fulfilled, we will permanently delete the data or deactivate access to it (i.e., it will be anonymized), unless we are legally required to retain the data or there is another applicable legal basis for its further processing. The criteria for determining how long we retain the data are: (i) legal obligations and (ii) as applicable, to fulfill and process a request you have submitted to us.

If the basis for processing is your consent and you withdraw that consent, we will permanently delete your personal data, unless we are required by law to retain it.

1. Visiting the Website

When you visit the website, the browser you use on your device will automatically—without any action on your part—send the following information to our website’s server: the IP address of the device from which the request was sent and which has Internet access; the date and time of access; the name and URL of the file accessed; the website from which the request originated (the referrer URL); the browser you are using and, if applicable, the operating system of the computer connected to the Internet, as well as the name of your Internet service provider. This data is temporarily stored by the server in a so-called log file.

The purpose of processing the IP address is to establish a continuous connection and ensure convenient use of the website, as well as to assess the security and stability of the system. The legal basis for collecting this data is our legitimate interest arising from the purpose (Article 6(f) of the GDPR). This data will be stored only for the duration of your visit to the website.

2. Online shopping

THE PER BRAND processes personal data for the purpose of exercising the rights and obligations under sales contracts concluded on the basis of orders placed through online stores (“Online Shopping”), in accordance with the General Terms and Conditions.

The personal data we may collect from you in connection with online shopping generally includes:

- Identification data: first and last name;

- Contact information: email and phone number;

- Delivery address details: city, municipality, ZIP code, street and number, apartment/house, floor, apartment number;

During an online purchase, the following data is automatically collected; this data does not directly reveal your identity but is collected and processed for the purpose of recording orders to prevent potential fraud: your IP address (anonymous) and the date and time of purchase.

If you return the order within the contract withdrawal period, we will also need to collect your address information, as well as your bank account number, to process the refund.

The data we process in connection with online shopping is also processed to fulfill legal obligations related to your order or cancellation, such as resolving complaints and returns, detecting and/or preventing abuse or fraud, and sending replacement items.

Payment information is processed by our payment service providers. We do not store complete payment card numbers.

We share your first and last name, shipping address, email address, and phone number—provided when you confirm your order—with our logistics partners so that we can prepare the products in your order and deliver them to the address you specified. Our business partners are authorized to use this information and contact you solely for the purpose of delivering individual shipments.

Identification data, contact information and delivery address information are collected for the purpose of fulfilling the order, providing order status updates, processing complaints and returns, detecting and/or preventing abuse or fraud, sending replacement goods, and product recalls. The legal basis for storing this data is that it is necessary for the performance of the contract and for taking steps prior to entering into a contract in connection with the order (Article 6(b) of the GDPR) and to comply with our legal obligations (Article 6(c) of the GDPR). The data retention period for order fulfillment and the provision of order status information is typically until the expiration of one year from the mandatory retention periods associated with the order (with a minimum of 10 + 1 years), while the retention period for data related to handling complaints and returns, detecting and/or preventing abuse or fraud, sending replacement goods, and product recalls is typically up to one year after the statute of limitations for obligations related to the order has expired (with a minimum of 5+1 years).

Your address and bank account number are processed in connection with refunds resulting from withdrawal from the contract. This is necessary to comply with our legal obligations (Article 6(c) of the GDPR). The retention period for this data is ten years from the date of the refund.

The legal basis for processing the contact and address information you provide to us in connection with our ordering services is our legitimate interest in optimizing delivery and fulfillment for our customers (Article 6(f) of the GDPR). This data will be retained until the order is completed.

3. Marketing and messaging

In connection with our marketing activities, we may process your contact information to send you notifications and information about offers, and we may also process personal data that helps us tailor offers and content to your interests and expectations.

The legal basis for processing the collected contact information for direct marketing is your consent (Article 6(a) of the GDPR), and this data will be retained until you withdraw your consent.

4. Different types of inquiries

Depending on how you contacted us and the nature of your inquiry, we may collect information such as your name, phone number, email address, and any other information you have shared with us in connection with your inquiry.

Our and, consequently, your interest in this data processing stems from the need to answer your questions, resolve any existing issues if necessary, and ensure your satisfaction as our customer or as a user of the website.

The legal basis for this data processing is Article 6(1)(b) of the GDPR, insofar as the processing of your data is necessary to respond to your questions or to process your request regarding a purchase you have made. In addition, we have a legitimate interest in responding to general inquiries that are not directly related to a contractual relationship. In this case, the legal basis for data processing is our legitimate interest (Article 6(1)(f) of the GDPR) in providing you with a prompt and specific response to your inquiry, as you have expressly requested (e.g., information on general delivery times, availability of sizes or products).

The retention period for this data varies and is as follows:

- when responding to an inquiry regarding a future or current order - typically until the expiration of one year from the statute of limitations for obligations related to the order (with a minimum of 5+1 years) or one year from the date of the response, if there is no order;

- when responding to an inquiry regarding a complaint, return of goods, or withdrawal from the contract - typically until one year after the statute of limitations for obligations related to the order expires (with a minimum of 5+1 years);

- when responding to an inquiry regarding our and/or your rights and obligations or the products and/or services we offer - typically until the expiration of one year from the statute of limitations for obligations related to the order (with a minimum of 5+1 years) or one year from the response, if there is no order;

- when responding to other inquiries - up to one year from the date of the response to the inquiry

5. Filing, pursuing, and defending claims

We may process your personal data in connection with our right to bring, pursue, or defend against claims arising from the contractual relationship between you and us or related to your use of the services or features we provide.

Identification data, information regarding a specific order or offer, and transaction details are stored for the purpose of potentially asserting, pursuing, or defending against claims. The legal basis for processing this data is our legitimate interest in bringing, pursuing, or defending against claims to which we are entitled (Article 6(f) of the GDPR). The retention period for this data is typically until the expiration of the statute of limitations (5 + 1 years), unless it is objectively necessary for a longer period (e.g., in the event of ongoing litigation).

6. Data we do not process

We do not intentionally process data related to racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, genetic data, biometric data for the purpose of uniquely identifying individuals, health data, or data concerning sexual life or sexual orientation.

If it becomes necessary to process any of the aforementioned personal data, we will always require your explicit consent.
