These Terms apply to all customers located within the European Union and internationally where delivery is offered.

 

2. DEFINITIONS

• “Seller”, “we”, “us” – THE PER BRAND Ltd

• “Customer”, “you” – any individual or legal entity placing an order

• “Products” – all items offered for sale, including tote bags and accessories

• “Website” – www.theperbrand.com

• “Contract” – agreement between Seller and Customer upon order confirmation

3. ELIGIBILITY TO PURCHASE

To place an order, you must:

• be at least 18 years old, or have legal capacity in your country

• provide accurate and complete personal information

• use the Website in accordance with applicable laws

We reserve the right to refuse service if fraudulent or suspicious activity is detected.

4. PRODUCT INFORMATION

We strive to ensure that all product descriptions, images, and specifications are accurate.

However, you acknowledge that:

• colors may vary depending on screen settings

• natural materials may have slight variations in texture and appearance

• minor deviations in size (within reasonable tolerance) may occur due to manufacturing processes

Such variations do not constitute defects.

5. PRICING AND PAYMENT

All prices are displayed in EUR.

Prices:

• include VAT where applicable

• exclude delivery costs unless explicitly stated otherwise

• may be updated at any time without prior notice (changes do not affect confirmed orders)

Accepted payment methods may include:

• credit/debit cards (via Shopify Payments)

• other methods displayed at checkout

Payment is required in full at the time of order unless otherwise specified.

We use secure third-party payment processors; we do not store full payment card details.

6. ORDERING PROCESS

When you place an order:

1. You select Products and add them to your cart

2. You provide billing and delivery details

3. You confirm payment

4. You receive an order confirmation email

The display of products on the Trading Platform does not constitute a legally binding offer, but rather a non-binding online catalog. By clicking the “Order and Pay Now” button, you are placing a binding order for the items in your shopping cart. An order confirmation is issued immediately after the order is placed and does not yet constitute acceptance of the contract.. A binding contract is concluded only when we send an order confirmation email.

We reserve the right to cancel or refuse orders in cases including but not limited to:

• product unavailability

• pricing or listing errors

• suspected fraud or misuse

• incomplete or incorrect customer data

If an order is cancelled after payment, a full refund will be issued.

7. DELIVERY

We deliver to:

• Bulgaria

• European Union countries

Delivery times (estimated):

• Bulgaria: 2-5 business days

• EU: 4-7 business days depending on destination

Delivery times are estimated and not guaranteed.

We are not responsible for delays caused by:

• courier companies

• customs clearance

• force majeure events

Risk of loss or damage passes to you upon delivery.

8. SHIPPING COSTS AND CUSTOMS

Shipping costs are calculated at checkout and depend on destination and order size.

For deliveries outside the EU or to non-EU territories:

• customs duties, import taxes, or additional fees may apply

• these costs are the responsibility of the Customer

We have no control over such charges and cannot predict them.

9. RIGHT OF WITHDRAWAL (EU CONSUMER RIGHTS)

If you are a consumer within the EU, you have the right to withdraw from your purchase within 14 days without providing any reason.

Withdrawal period:

The period expires 14 days from the day you receive your order.

Conditions:

To be eligible for a return:

• Products must be unused, unworn, and in original condition

• All original packaging and tags must be included

• Items showing signs of use may be rejected or partially refunded

Exclusions:

The right of withdrawal may not apply to:

• customized or personalized products (if applicable)

• items damaged after delivery due to customer misuse

10. RETURNS PROCESS

To initiate a return, you must contact us at:

• order number

• reason for return

• product details

After approval, you will receive return instructions.

Return shipping costs:

Unless otherwise stated, return shipping costs are borne by the Customer.

We recommend using a tracked shipping method.

11. REFUNDS

Once returned items are received and inspected, we will notify you of approval or rejection.

If approved:

• refunds will be processed within 14 days maximum (typically 5–10 business days)

• refunds will be issued via the original payment method

We reserve the right to deduct value reduction if products are returned damaged or used.

12. DEFECTIVE OR FAULTY PRODUCTS (WARRANTY)

If you receive a defective or incorrect product, you are entitled to a remedy under applicable EU consumer law.

You may request:

• repair (if applicable)

• replacement

• full or partial refund

Please notify us within a reasonable time after discovering the defect.

If the delivered goods have obvious defects in materials or workmanship, including damage incurred during shipping, please notify us or the relevant employee of the shipping service provider delivering the goods of such defects immediately. However, failure to file such a complaint will not affect your statutory warranty rights. You have statutory warranty rights for all defects in the purchased goods that arise during the statutory warranty period. The merchant does not provide any additional warranties for defects beyond those provided by law.

13. RETENTION OF OWNERSHIP RIGHTS

Ownership of goods remains with the Seller until full payment is received.

14. INTELLECTUAL PROPERTY RIGHTS

All content on the Website, including but not limited to:

• product designs

• photographs

• branding elements

• logos

• text and graphics

is the exclusive property of THE PER BRAND or its licensors.

Any unauthorized use, reproduction, or distribution is strictly prohibited.

15. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

We are not liable for:

• indirect or consequential damages

• loss of profits or revenue

• delays caused by third-party carriers

• misuse of products

Nothing in these Terms excludes liability where such exclusion is not permitted by law (e.g. death or personal injury caused by negligence).

15. WEBSITE AVAILABILITY DISCLAIMER

We do not guarantee uninterrupted availability of the Website.

We process personal data in accordance with Regulation (EU) 2016/679 (GDPR).

Changes do not affect orders already confirmed.

20. GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of:

• Republic of Bulgaria

• applicable European Union consumer protection regulations

All disputes between the parties shall be resolved in a spirit of understanding and goodwill. In the event that an agreement cannot be reached, except where prohibited and without limitation to any statutory rights for consumers, all unresolved disputes arising out of or relating to the contract between the parties, including disputes arising out of or relating to its interpretation, invalidity, performance, or termination, as well as disputes regarding the filling of gaps in the contract or its adaptation to newly arising circumstances, shall be resolved by the competent court of registration of THE PER BRAND in accordance with Bulgarian law..

Disputes between the Seller and the Customer may also be resolved out of court. In such cases, the Customer may contact the authority responsible for out-of-court dispute resolution – the Commission for Consumer Protection. More information is available at www.kzp.bg
